As defined by the code, these offenses were considered capital crimes, thereby incurring the potential for the death penalty. As per the code's stipulations, the procedure for a military tribunal necessitated the presence of three Magistrates, in addition to legal representatives for both the defense and the prosecution. Both sides possessed the authority to summon witnesses, engage in cross-examination, and pose inquiries regarding various aspects pertinent to the trial. Following the presentation of evidence by each party, the Magistrates would engage in deliberations, ultimately rendering a verdict and determining a corresponding sentence. The prosecution would initially present its arguments, succeeded by the defense, and concluding with closing statements from both sides.
The code expressly forbade the defendant from engaging in private discussions with the Magistrates, a privilege exclusively reserved for the designated legal advocates.
